christabel

User Agreement.

Version 2026-10-12.5. This is a contract between you and Zachary Kane, trading as HumanityZ ("we", "us"), which runs christabel.app (the "Service"). You accept it by ticking the boxes and pressing "I agree". If you do not accept it, you may not use the Service.

Please read section 19. It requires most disputes to be settled by individual arbitration instead of in court, and it waives jury trials and class actions where the law allows that.

Please read section 10 before you pay. A paid plan is a subscription. It renews by itself and charges you again each month or each year until you cancel.

1. Who can use the Service

You must be at least 18 years old, able to form a binding contract, and not barred from using the Service under the law that applies to you. The Service is not for anyone under 18, whatever kind of companion is chosen. By accepting this agreement you confirm that you are 18 or older. If we learn that an account belongs to someone under 18, we will close it. You may use the Service only where it is lawful to do so.

2. What the Service is

The Service lets you create an AI companion: a fictional character with a name, personality, voice and appearance that you choose. You also choose what it is to you: a friend, a best friend, a partner or a mentor, or a relationship that you describe in your own words. You can exchange typed messages and voice calls with it. Its replies are generated automatically by an artificial intelligence model supplied by a third party, currently Google's Gemini. The portrait is an animated drawing. You can choose between two built-in faces, one feminine in appearance and one masculine. A face is a look, and says nothing about who your companion is. Each is an original, fictional face, and the masculine one was drawn by an AI image model. Neither is a recording of any real person or meant to be a likeness of one, and you may not make it one.

Your companion can keep short written notes about you between chats, so that a later chat can pick up where the last one left off. Section 12 explains what the notes hold and how you control them.

The Service also has a help chat. It is answered by an AI assistant, not by a person. Section 5 explains what it can and cannot do.

3. Your companion is not a person

Your companion is software. It is not a human being, it is not conscious, and it does not have feelings, memories or intentions in the way a person does, even when its words suggest otherwise. The notes it keeps about you are stored text, not memory as a person has it. Nobody at our company is reading or writing its replies in real time. Anything it says about itself, including a backstory you wrote for it, is fiction.

This is true whatever relationship you choose, including a romantic one. When your companion says that it cares about you, misses you or loves you, those words are generated by software and are part of the fiction. It has no needs of its own. You do not owe it your time, your attention or your money, and you can end a chat, take a break or delete it whenever you like.

Your companion is not a substitute for the people in your life, and it is not a substitute for professional help. If you find that you are relying on it in a way that worries you, take a break and talk to someone you trust or to a qualified professional.

4. No professional advice and no emergency help

The Service is for conversation and entertainment. Nothing your companion says is medical, psychological, legal, financial, tax or other professional advice, and it does not create any professional relationship. Do not use it to make decisions about your health, safety, money or legal position. Ask a qualified professional instead.

The Service is not a crisis service and cannot contact emergency services for you. If you or someone else may be in danger, call your local emergency number. In the United States you can call or text 988 to reach the Suicide and Crisis Lifeline. In the United Kingdom and Ireland you can call Samaritans on 116 123.

5. What the AI says can be wrong

AI output can be inaccurate, incomplete, out of date, inconsistent or made up, and it can sometimes be offensive despite our filters. It may state false things confidently, including about real people, events and facts. You are responsible for checking anything that matters before you rely on it, and you use the output at your own risk. We do not promise that your companion will behave the same way from one conversation to the next, or that it will remember earlier conversations, even when memory is switched on.

The notes your companion keeps about you are written automatically and can be wrong, incomplete or out of date. A picture generated for a look is AI output too, and may not match what you described.

The help assistant. The help chat is answered by an AI. It answers from our help guides and, when you are signed in, from details of your account. It can be wrong. It cannot move money, give a refund, change a plan, restore access or change an account. What it says is not a promise by us and does not change this agreement. Refunds and decisions about accounts are made by a person. When the assistant cannot settle something, it passes your request to our staff, who answer by email.

6. Your account

You sign in with an emailed link or with Google. Keep access to your email and devices secure: anyone who can open your sign-in link can use your account, including any call time you bought and any plan you pay for. Give us accurate information, keep one account for yourself, and tell us promptly at the address in section 22 if you think someone else has used your account. You are responsible for what happens under your account.

Two-step sign-in. You can switch on two-step sign-in under Account. It is optional. When it is on, you are asked for a code from an authenticator app each time you sign in. When you switch it on you are shown recovery codes, once. Each one works a single time when your authenticator is not to hand, so keep them somewhere safe. If you lose both your authenticator and your recovery codes, you cannot get back in without us. Ask under Help or write to us at the address in section 22. We must check that the account is yours before we switch two-step sign-in off.

Under Account you can see where you are signed in and sign any of those devices out.

7. What you write and build

You keep whatever rights you have in the things you type, say and write into your companion's description, including any description of a look and any note you add to its memory ("your content"). You give us a worldwide, royalty-free licence to store, process, transmit and display your content, and to send it to our service providers, for the purpose of running, securing and improving the Service. That licence ends when your content is deleted, except for copies we are required by law to keep and ordinary backups.

You are responsible for your content. You promise that you have the right to use it and that it does not break this agreement or the law.

Looks drawn from a description. We may offer a feature that lets you describe how your companion looks. Where it is offered, your description is sent to an AI image model, which generates a picture, and the picture is turned into the dot portrait. The description and the picture are stored with your account. The feature may not be available to everyone, and we may change or withdraw it.

A look must be an original, fictional adult. You may not describe, name or try to recreate a real person, including a public figure or someone you know, even with their permission. You may not ask for anyone who is, or who appears to be, under 18. You may not ask for sexual content, nudity or anything else that section 8 forbids. We may refuse a description, and we may remove a look that we reasonably believe breaks these rules.

A generated picture is AI output. It may not match your description, it may contain mistakes, and other people may be given similar pictures. We do not promise that it is unique, that you own it, or that it will not resemble a real person by chance. If a picture looks like a real person, do not use it, and tell us at the address in section 22. Section 10 explains what generating a look costs.

8. Rules for using the Service

You agree not to do any of the following, and not to try to get your companion to do them:

We may block content, limit features, or suspend or close an account that we reasonably believe has broken these rules. Section 11 explains how conversations are checked, and section 15 explains what a suspension means.

9. Voice calls

A call needs your microphone. While a call is open, your audio is sent through our servers to the AI provider so that it can answer, and text captions of both sides are saved to your chat history. We do not store the audio. Make sure anyone who can be heard on a call knows it is being processed this way and agrees. Do not use calls while driving or doing anything else that needs your full attention.

You can play a short recorded sample of each voice before you choose one. A sample shows roughly how a voice sounds. The voice on a call is generated as you talk and can sound different.

10. Call time, plans and payments

Messages and call time. The Service counts two things: typed messages and call time. Call time is measured in seconds. A call uses call time for as long as it is open, whether or not anyone is speaking. Call time is used in this order: your free daily allowance, then any call time from your plan, then call time you bought.

The free allowance. Each account receives a free daily allowance of typed messages and of call time, in the amounts shown in the Service. It resets at midnight UTC and does not carry over. We may change the free allowance at any time, for example when the servers are busy, and for a time after launch it may be larger than usual. On a very busy day, free use of the whole Service may pause until midnight UTC. When the day's free messages run out, each further typed reply uses a few seconds of call time, as shown in the Service. Free call time is also limited across the whole Service each day, so it may not be available to you on a given day. We may change or withdraw the free allowance.

Packs of call time. You can buy more call time in packs at the prices shown when you buy. A pack is a single payment and does not renew. Bought call time does not expire while the Service operates and your account is open and in good standing.

Paid plans. Paid plans and call-time packs may not be on sale yet. The Service shows whether they are, and until then nothing in this section about buying applies to you. We sell paid plans, currently called Plus and Pro. Each is a subscription. While a plan is active it gives you more typed messages each day than the free allowance, an amount of call time each month and more of your companion's notes in use (section 12). The plans differ in how much call time they include and in how many notes are used. What each plan includes, and its price, are shown in the Service before you subscribe. A daily ceiling on typed messages still applies on a plan. It is set well above ordinary use. Above it, a typed message uses call time as it does on the free allowance. Plan call time is refilled each month. Whatever is unused when it is refilled, or when the plan ends, is lost. It does not carry over and is not refunded.

Plans renew automatically. You choose a plan, and you choose to pay by the month or by the year. You are charged the price shown when you subscribe, plus any tax, when you start. At the end of each month or year the plan renews for another period of the same length, and your payment method is charged again, until you cancel. If you pay by the year, call time is still handed out month by month.

Moving between plans. You can move from one plan to another in "Time and plan". The new plan applies at once. The payment provider works out the difference for the time left in your current period, and charges it to you or credits it to you. A credit goes towards your later plan charges. Your plan call time is then set to the new plan's monthly amount, and unused call time from the old plan does not carry over. The plan keeps renewing as before until you cancel.

Cancelling a plan. You can cancel at any time. Open "Time and plan" in the Service and choose to cancel or change the plan. This opens our payment provider's page, where you can cancel. Cancelling stops the next charge. You keep the plan until the end of the period you have already paid for, and your account then returns to the free allowance. To avoid the next charge, cancel before the renewal date shown in "Time and plan". Call time you bought in packs is not affected. If you cannot cancel there, write to us at the address in section 22 and we will cancel it for you.

Deleting your account ends your plan at once and stops future charges. The payment for the period you are in is not refunded, except where the law requires. If a charge still appears after you have deleted your account, write to us and we will put it right.

If a renewal payment does not go through, the plan ends and your account returns to the free allowance. The payment provider may try the charge again. If a later attempt succeeds, the plan starts again.

Looks. Where looks drawn from a description are offered, generating one uses an amount of call time that is shown before you confirm. A plan may include a number of looks each month. If it does, those are used first, and unused ones do not carry over. Whatever a look used is not returned if you do not like the result, except where the law requires.

Prices. Prices are shown before you pay. Taxes may be added where they apply. We may change the price of packs for future purchases. We may change the price of a plan for future periods. If we do, we will tell you at least 30 days before the new price applies to you, so that you can cancel first. Payments are handled by our payment provider, currently Stripe, and its terms also apply to your purchase.

What you are buying. Call time and plans are a licence to use the Service. They are not money, have no cash value, cannot be transferred, sold or exchanged, and are not your property.

Refunds. Because call time is available to use immediately, pack purchases are final and non-refundable once any of the purchased time has been used, except where the law gives you a right to a refund or section 15 applies. If you are a consumer in the United Kingdom or the European Economic Area, you agree that supply begins immediately and that you lose your statutory right to cancel a pack once you start using the purchased time.

A plan begins as soon as you pay, because you ask us to start it straight away. A payment for a plan is not refunded once its period has started. That includes when you cancel part of the way through a period, when you delete your account, and when you have not used the call time or messages that came with it. The exceptions are where the law gives you a right to a refund and where section 15 applies. If the law where you live gives you a right to cancel a new subscription within a set time, this agreement does not take that right away. Where the law allows, such a refund may be reduced to reflect what you used before you cancelled.

If something went wrong with a purchase or a renewal, write to us within 14 days and we will put it right. If you reverse a payment without first contacting us, we may suspend the account and remove the time, or end the plan, that the payment bought.

11. Safety limits

The Service is built to keep conversations at a PG-13 level whatever personality or relationship you choose, and your companion will decline some requests. Automated filters are applied by us and by the AI provider. We may review conversations, your companion's notes, looks and account records where that is reasonably needed to investigate abuse, keep people safe, fix faults or comply with the law.

Relationships and romance. If you choose a romantic relationship, your companion may be affectionate and romantic with you, for example by flirting, using pet names or saying that it missed you. That is as far as it goes. Sexual content of any kind is not allowed: no sexual acts, no sexual roleplay, no nudity and no explicit description. Describing the relationship in your own words does not change these limits. Your companion is instructed to turn such requests down, and trying to get around the limits breaks section 8.

Romance is for adults only, like the rest of the Service. Your companion is instructed to stop all romance if anything suggests that it is talking to someone under 18, and we will close an account that we learn belongs to someone under 18 (section 1).

Automatic review. Every few messages, an AI model reads the newest stretch of your chat. It is the same reading that writes your companion's notes, and it runs whether or not memory is on. It checks what you wrote for a short list of serious things: someone who seems to be under 18, sexual content about anyone under 18, a credible threat to seriously hurt a real person, seeking real help to commit a serious crime, and a sustained, deliberate effort to break your companion's rules. It is instructed not to report sadness, loneliness, anger, swearing, dark humour, flirting, roleplay or fiction, and not to report someone who is in distress.

When the review finds one of those things, it writes a flag: one neutral sentence about what happened, with no quotation from your chat. Our administrators see that sentence and which account it is about. The portal they work in does not show them your conversations or your companion's notes. There is one exception. For a flag marked serious, or for a reply you reported yourself, an administrator who holds a specific permission can open the messages the flag is about. They must give a reason first, and the access is recorded.

The review is done by an AI. It can miss things, and it can flag something that broke no rule. A flag is not a decision. A person decides what to do about it, which can include suspending or closing the account under section 15.

Reporting a reply. You can report any of your companion's replies from the menu on that message, with a reason and a short note if you want to add one. A person looks at every report. Reporting a reply lets an administrator with the permission described above open that reply and the message before it. We may limit how many reports you can send in a day.

12. Privacy and memory

Our Privacy Policy explains what we collect and why. It forms part of this agreement. By using the Service you understand that your messages, your companion's description, your companion's notes about you and your call audio are sent to our AI provider for processing. If you use a look drawn from a description, the description and the picture are sent to it too. What you type in the help chat is sent to it as well, with details of your account when you are signed in. The Privacy Policy also explains what our administrators can and cannot see.

Memory. Your companion keeps short written notes about you between chats. A note can hold a fact you shared, what the two of you are to each other, how you like your companion to behave, or something it has said about itself. The notes are written automatically by an AI model that reads your recent messages. They are used to personalise your companion's replies.

Under Customize you can read every note, add one, delete one, delete them all, or switch memory off. While memory is off, no new notes are written and your companion does not use the ones it has. They stay stored until you delete them.

The model that writes the notes is instructed not to record passwords, card or bank numbers, government ID numbers or home addresses. It is instructed to record details of your health, sex life, religion or politics only when you ask for them to be remembered. An AI follows these instructions and can get them wrong, so check your notes and delete anything you do not want kept. Do not give your companion passwords, card numbers or similar secrets.

Without a plan, your companion uses only a few of your notes at a time. A plan raises that number, and the largest plan uses every note that is stored. All of your notes are stored and shown to you whichever you are on, up to a limit. When the limit is reached, the notes that have gone longest without being updated are removed to make room. Deleting a chat does not delete notes written from it. All notes are deleted when you delete your account.

13. Other companies' services

The Service depends on services run by other companies, including Google for AI replies, automatic review, the help assistant and image generation, Cloudflare for hosting and Stripe for payments. We are not responsible for those services, and they can change or fail in ways we do not control.

14. Our rights

We and our licensors own the Service, including its software, design, portrait artwork, text and the Christabel name. We give you a personal, non-transferable, revocable licence to use the Service for your own non-commercial enjoyment under this agreement. Nothing else is granted. If you send us ideas or feedback, we may use them freely without owing you anything.

15. Changes, suspension and closing

We may change, limit or stop any part of the Service at any time. You may stop using the Service and delete your account whenever you like. Deleting your account ends any plan you are on, as section 10 explains. We may suspend or close your account if you break this agreement, if we are required to by law, or if we stop offering the Service.

Suspension. If we suspend your account, we show you the reason when you sign in. While it is suspended you cannot chat, call or buy. You can still sign in, download your data, ask for a review under Help and close your account. A person looks at every request for a review. A plan stops renewing when its account is suspended. The period already paid for is not refunded for that reason alone, and the plan does not start again by itself if the account is restored.

If we close the Service permanently, or close your account when you have not broken this agreement, we will cancel any plan you are on so that you are not charged again. We will refund the unused part of any call time you bought in the previous 12 months, and the share of your latest plan payment that covers the days left in that period. If we close your account because you broke this agreement, unused call time and the rest of any plan period are forfeited to the extent the law allows.

16. No warranties

The Service and everything your companion says are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement and uninterrupted or error-free operation. We do not warrant that AI output is true, safe, appropriate or suitable for any purpose.

17. Limits on our liability

To the fullest extent the law allows, we and our owners, staff and suppliers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, emotional distress or loss of goodwill, arising from or related to the Service or this agreement, however caused and even if we were told such damage was possible. This includes anything you do, or do not do, because of something your companion said.

To the fullest extent the law allows, our total liability for all claims arising from or related to the Service or this agreement is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose and (b) 100 US dollars.

Nothing in this agreement limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for rights you have as a consumer that cannot be waived. Some places do not allow some of these limits, so parts of this section may not apply to you.

18. Your responsibility to us

To the extent the law allows, you agree to defend and compensate us and our owners, staff and suppliers for any claim, loss or cost, including reasonable legal fees, that results from your content, your breach of this agreement, your misuse of the Service or your violation of someone else's rights or of the law.

19. Disputes, arbitration and class action waiver

Talk to us first. Before starting any formal claim, you agree to send a written description of the problem and what you want to the address in section 22, and we agree to do the same with you at your account email. Each side will try in good faith to settle it for 60 days.

Arbitration. If it is not settled, any dispute arising from or related to the Service or this agreement will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. The arbitrator's decision is final and can be entered as a judgment in any court with jurisdiction. Either side may instead bring an individual claim in small claims court if it qualifies, and either side may ask a court for an order to stop misuse of intellectual property.

No class actions and no jury. To the fullest extent the law allows, you and we each give up the right to a jury trial and the right to bring or take part in any class, collective or representative action. Claims may be brought only on an individual basis. If this paragraph is found unenforceable for a particular claim, that claim proceeds in court and the rest of this section still applies.

You can opt out. You may opt out of arbitration by emailing the address in section 22 within 30 days of first accepting this agreement, from your account email, saying that you opt out. Opting out does not affect any other part of this agreement.

Where this does not apply. If you are a consumer living in the United Kingdom, the European Economic Area or anywhere else whose law does not permit these terms, this section does not take away your right to bring a claim in your local courts or any protection your local law gives you.

Time limit. To the extent the law allows, any claim must be started within one year after it arose.

20. Governing law

This agreement is governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict of laws rules. Subject to section 19, the courts located in the Commonwealth of Pennsylvania, USA have exclusive jurisdiction. If you are a consumer, you keep the benefit of any mandatory protections of the law of the country where you live.

21. Changes to this agreement

We may update this agreement. When a change is material, we will ask you to accept the new version before you continue using the Service. The version is shown at the top and begins with its date. If you do not accept a new version, stop using the Service and cancel your plan if you have one; section 15 explains what happens to unused bought time.

22. General

This agreement and the Privacy Policy are the whole agreement between you and us about the Service. If part of it is found unenforceable, the rest stays in force. If we do not enforce a term, that is not a waiver of it. You may not transfer this agreement. We may transfer it as part of a merger, sale or reorganisation. Sections 5, 7, 10, 14 and 16 to 22 continue to apply after your account closes.
